Terms of Service

Please read these Terms carefully before using FluoTest.

1. Introduction

FluoTest is a digital product created and owned by FluoSite (Dominik Sikora), registered in the Netherlands. By accessing or using FluoTest, you agree to these Terms of Service. If you do not agree, you may not use the product.

2. Description of the Service

FluoTest provides interactive lead-qualification tools, allowing users to create, publish and share quizzes that collect responses from visitors. Features may change or improve over time.

3. Eligibility

You must be at least 18 years old to use FluoTest. By using the product, you confirm that you meet this requirement and have legal capacity to enter into this agreement.

4. Accounts and Access

Some features may require an account or early-access registration. You must provide accurate information and are responsible for maintaining the security of your access credentials.

5. Early Access

FluoTest may provide beta or early-access features that are experimental, may change at any time, and may be discontinued without notice. You understand that early-access features may contain bugs or limitations.

6. Features

FluoTest supports multiple question types including yes/no, open text, slider, star rating and number input. Each question type may be assigned a weight multiplier that affects the total score calculation. FluoTest temporarily stores quiz respondent progress to allow resuming an incomplete quiz; this data is session-based and deleted upon completion. Quiz owners who accept the showcase invitation agree to have their quiz name and link displayed publicly on fluotest.com/showcase; this consent can be withdrawn by contacting [email protected]. Quiz owners who accept the logo invitation agree to have their company logo displayed on the fluotest.com homepage; this consent can be withdrawn by contacting [email protected]. Quiz owners can additionally customize the results email sent to respondents (including an optional PDF results attachment), embed quizzes on their own websites using the FluoTest embed widget, apply custom CSS to public quiz pages, set quiz timers and response limits, and import existing quizzes from ScoreApp. Quiz owners are responsible for the pages where they embed their quizzes, for the content of their customized results emails, and for the effects of any custom CSS they add.

7. Billing & Subscriptions

FluoTest offers a free tier and a paid Pro subscription, billed monthly or annually through our payment processor, Stripe. By subscribing you authorize us, via Stripe, to charge your payment method the applicable fee plus any taxes on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your account settings; cancellation stops future renewals and your Pro features remain active until the end of the current paid period. Fees are stated in EUR and, except where required by law, payments are non-refundable, including for partial billing periods. We may change prices or plans with advance notice; changes apply from the next billing cycle. The first 100 users are grandfathered into Pro free of charge. Non-payment may result in a downgrade to the free tier or suspension of Pro features.

8. User Content

You may input quiz questions, text and content into FluoTest. You retain ownership of your content, but grant FluoSite a limited license to store and process it solely for providing the service.

9. User Responsibilities

You agree not to misuse the service, including attempting to access systems without authorization, reverse-engineering the product, uploading harmful code, or using FluoTest to collect unlawful or sensitive data.

10. Acceptable Use

Quiz owners may not use FluoTest to collect sensitive personal data through quiz questions, including health information, financial account details, government ID numbers, passwords or payment card data. Quiz owners are responsible for ensuring their use of third-party integrations (including Brevo, Zapier, Make, n8n, Webhooks, Meta Pixel, Google Tag Manager, Google Sheets, Slack, HubSpot, Mailchimp, Notion and Airtable) complies with applicable privacy laws including GDPR.

11. Third-Party Integrations

By configuring third-party integrations, quiz owners confirm they have the legal right to send respondent data to those services and that doing so complies with applicable data protection laws. FluoTest is not responsible for how third-party services process respondent data. Brevo API keys provided by quiz owners are stored encrypted and used solely to sync data to the quiz owner's own Brevo account; FluoTest does not use quiz owner API keys or connected accounts for any other purpose. Where you connect a service via OAuth (such as Google Sheets, Slack, HubSpot, Mailchimp or Notion), you authorize FluoTest to send the data you configure to that account on your behalf, and you may revoke access at any time by disconnecting the integration or from the provider. If you invite collaborators to a team workspace, you are responsible for their access to respondent data within that workspace.

12. API & Programmatic Access

FluoTest provides an API and an MCP (Model Context Protocol) server that let you manage your quizzes and read your submissions programmatically, including through AI assistants you authorize via OAuth. API keys and OAuth grants are tied to your account: keep them confidential, and all activity performed with them is treated as activity under your account. You can revoke API keys and disconnect authorized applications at any time from your account settings. We may throttle, limit or suspend programmatic access that abuses or disrupts the service.

13. Intellectual Property

All branding, UI design, software code and features of FluoTest are the intellectual property of FluoSite. You may not copy, reproduce, or commercially exploit the service without written permission.

14. Limitation of Liability

To the maximum extent permitted by law, FluoSite is not liable for indirect, incidental or consequential damages, data loss, loss of revenue or any issues arising from use of the service. The service is provided on an 'as-is' and 'as-available' basis. Nothing in these Terms limits any rights you have as a consumer that cannot be excluded under applicable law.

15. Termination

We may suspend or terminate access to FluoTest if you violate these Terms or misuse the service. You may stop using the service at any time.

16. Changes to Terms

We may update or change these Terms from time to time. When changes are significant, we will provide notice or update the 'Last updated' date.
