Terms of Service

Please read these Terms carefully before using FluoTest.

1. Introduction

FluoTest is a digital product created and owned by FluoSite (Dominik Sikora), registered in the Netherlands. By accessing or using FluoTest, you agree to these Terms of Service. If you do not agree, you may not use the product.

2. Description of the Service

FluoTest lets you build scored quizzes and assessments, publish and embed them, and automate what happens after someone answers: showing a result page and optional result video, sending emails to respondents, notifying you and your team, and passing data to the tools you connect. It also includes a contacts view for following up with respondents and team workspaces for working together. Features may change or improve over time.

3. Eligibility

You must be at least 18 years old to use FluoTest. By using the product, you confirm that you meet this requirement and have legal capacity to enter into this agreement.

4. Accounts and Access

Most features require an account. You must provide accurate information and are responsible for keeping your login and any API keys secure. You can create workspaces to separate your quizzes; inviting other people into a workspace requires a paid plan.

5. Early Access

FluoTest may provide beta or early-access features that are experimental, may change at any time, and may be discontinued without notice. You understand that early-access features may contain bugs or limitations.

6. Features

Quiz owners can use question types including multiple choice, multi-select, yes/no, open text, slider, star rating, number, date, contact fields and file upload, and can weight questions, use several scores, and route people to outcomes with rules. FluoTest temporarily stores a respondent's progress so an unfinished quiz can be resumed. Quiz owners can customize the results email (including an optional PDF), show a personalised result video (and upload their own video clips on paid plans), send follow-up and abandoned-quiz emails, keep notes, tasks and pipeline stages on contacts, embed quizzes on their own websites, apply custom CSS, set timers and response limits, and import quizzes from ScoreApp, Typeform, Google Forms, PDF, Word and CSV/JSON files. Quiz owners who accept the showcase or logo invitation agree to have their quiz name and link, or their company logo, shown publicly on fluotest.com; this consent can be withdrawn at any time by contacting [email protected]. Quiz owners are responsible for the content of their quizzes, results pages, emails and videos, for any clips or files they upload, for the pages where they embed their quizzes, and for the effects of any custom CSS they add.

7. Billing & Subscriptions

FluoTest offers a Free plan and paid Pro and Business plans, billed monthly or annually through our payment processor, Stripe. The Free plan is not a time-limited trial. All plans are subject to our Fair Use Policy. By subscribing you authorize us, via Stripe, to charge your payment method the applicable fee plus any taxes on a recurring basis until you cancel. Subscriptions renew automatically at the end of each billing period. You can cancel at any time from your account settings; cancellation stops future renewals and your paid features remain active until the end of the current paid period. You can switch from Pro to Business at any time; the change takes effect immediately and Stripe adjusts the charge for the rest of the period. Fees are stated in EUR and include VAT where applicable. Except where required by law (including the right of withdrawal below), payments are non-refundable, including for partial billing periods. We may change prices or plans with advance notice; changes apply from the next billing cycle. The first 100 users are grandfathered into Pro free of charge. Non-payment may result in a downgrade to the Free plan. If you are a consumer in the EU, you may withdraw from a new subscription within 14 days of purchase. Because your plan starts right away at your request, withdrawing within that period means you pay only for the days already used and we refund the rest. 8. User Content

You may input quiz questions, text and content into FluoTest. You retain ownership of your content, but grant FluoSite a limited license to store and process it solely for providing the service.

9. User Responsibilities

You agree not to misuse the service, including attempting to access systems without authorization, reverse-engineering the product, uploading harmful code, or using FluoTest to collect unlawful or sensitive data.

10. Acceptable Use

Quiz owners may not use FluoTest to collect sensitive personal data through quiz questions or file uploads, including health information, financial account details, government ID numbers, passwords or payment card data, and may not use file upload questions to collect or distribute malware or unlawful content. Follow-up, abandoned-quiz and results emails may only be sent to people who gave their email address in your quiz, and you are responsible for having a lawful basis for those emails; every follow-up email includes an unsubscribe link that FluoTest honours. Quiz owners are responsible for ensuring their use of third-party integrations (including Brevo, Zapier, Make, n8n, webhooks, Meta Pixel, Google Tag Manager, Google Sheets, Slack, HubSpot, Mailchimp, Notion and Airtable) complies with applicable privacy laws including GDPR.

11. Third-Party Integrations

By configuring third-party integrations, quiz owners confirm they have the legal right to send respondent data to those services and that doing so complies with applicable data protection laws. FluoTest is not responsible for how third-party services process respondent data. API keys provided by quiz owners (such as Brevo or Airtable) are stored encrypted and used solely to send data to the quiz owner's own account. Where you connect a service via OAuth (such as Google Sheets, Slack, HubSpot, Mailchimp or Notion), you authorize FluoTest to send the data you configure to that account on your behalf, and you may revoke access at any time by disconnecting the integration or from the provider. When you import from Typeform or Google Forms, you grant FluoTest read-only access to the forms you choose for that import session only; we do not keep that access afterwards. Hot-lead alerts and lead routing send respondent details to the people and Slack channels you choose. If you invite collaborators to a team workspace, you are responsible for their access to respondent data within that workspace.

12. Cookie Consent Settings

Published quizzes can show a cookie consent banner to respondents before any tracking tags fire. In Auto mode, the default, the banner is shown automatically to visitors in the EU/EEA and equivalent jurisdictions such as the UK and Switzerland, and only when the quiz owner has an active tracking integration such as Meta Pixel or Google Tag Manager; it stays off otherwise. Quiz owners can manually override this to Always show or Never show from the Integrations panel, regardless of which tracking integrations are active. If a quiz owner sets the banner to Never show while using tracking integrations that require visitor consent under applicable law, including GDPR and the ePrivacy Directive, the quiz owner is solely responsible for that choice and for their own compliance. FluoTest does not provide legal advice, and quiz owners should confirm their own legal obligations with a qualified professional.

13. API & Programmatic Access

FluoTest provides an API and an MCP (Model Context Protocol) server that let you manage your quizzes and read your submissions programmatically, including through AI assistants you authorize via OAuth. API keys and OAuth grants are tied to your account: keep them confidential, and all activity performed with them is treated as activity under your account. You can revoke API keys and disconnect authorized applications at any time from your account settings. We may throttle, limit or suspend programmatic access that abuses or disrupts the service.

14. Intellectual Property

All branding, UI design, software code and features of FluoTest are the intellectual property of FluoSite. You may not copy, reproduce, or commercially exploit the service without written permission.

15. Limitation of Liability

To the maximum extent permitted by law, FluoSite is not liable for indirect, incidental or consequential damages, data loss, loss of revenue or any issues arising from use of the service. The service is provided on an 'as-is' and 'as-available' basis. Nothing in these Terms limits any rights you have as a consumer that cannot be excluded under applicable law.

16. Termination

We may suspend or terminate access to FluoTest if you violate these Terms or misuse the service. You may stop using the service at any time.

17. Changes to Terms

We may update or change these Terms from time to time. When changes are significant, we will provide notice or update the 'Last updated' date.
